Rather than paying a solicitor try contacting your mortgage company or house insurance company and use the legal cover on one of them.

Oh yea I forgot - we will be forgiven our trespasses as we shall forgive them that trespass against us. Got it:-)
So if it's raining heavily and water is running down the walls, can Sbarrett sue the neighbour for the damage sustained because he is denied access to replace his guttering?
are all the houses on your side the same? seems very odd that someones garden could be right up to the back of your house. are you sure that some one hasnt put a fence up before you arrived, taking your garden?

check your deeds.

my aunties neighbour did something similar ... she viewed the house but nothing happened for months but when she finally bought it and moved in she noticed the garden was much smaller than it had been... neighbour had moved the fence... presumably thought they would be none the wiser...
my mums allow access to their neighbour, but only to one side of the house, not the back
This is not really my area, however, you do have certain rights under the Access to Neighbouring Land Act 1992 if it is for the repair of an existing structure. I suggest you seek legal advice.
