Hi me and my partner agreed to end our tenancy with our landlord 3 months early he told us that if he found a new tennant we would get our bond back now he has found a new tennant he has told us he is not giving our bond back can he do this thanks
I thought it is illegal these days not to keep bonds in a separate bank account? If he has a new tenant there is no need for him to withhold your bond.
make sure you don't give him the full amount of rent when you leave....minus the cost of the bond he already has. if i were you, i'd not pay him another penny, tell him to stuff the bond up his a** and to take you to court. and add that if he hadn't been such a Snag, you would have happily paid up. i've done that in the past with dodgy landlords who have tried to rip me off.
Inform your landlord in writing that since the 6 April 2007 the landlord or agent must use a government authorised scheme to protect deposits and must notify you within 14 days how the deposit will be protected. If they have failed to do this apply to the county court for an order for the landlord to repay the deposit
Unfortunately to start a case in the county court you will have to pay the charges, which you should be able to recover. The court will not recover the deposit for you it will be up to you to do this; which is very straightforward; hopefully the landlord or agent will not want a problem and will just pay.
