Bought a jacket off ebay I believe is fake

I have bought a second hand designer jacket off ebay, which after it arrived and having looked at it, I believe it to be fake. I have contacted the seller, who only reply was "its genuine". I have raised the issue with Ebay, I got a reply from the seller saying he wants photos and written expert proof in 7 days. I intend to take it to trading standards for them to have a look at it. Any other suggestions on what I can do?

He may have bought THINKING it is genuine but maybe it isn't.

Many people by fake items when they think they are buying the "real thing".
"buy" not "by"
Keep talking to eBay - they take a dim view of items which are not genuine, we are asked to declare if something may be an imitation of a branded item.

Why do you think it's fake?
How much did you pay for it ? is it worth taking to trading standards who will probably charge to look at it for you.
If you want to complain it is better to complain to the the holders of the copyright for the item and ask them for an opinion, they will take it up wih ebay if they think it is fake it is their reputation at stake.
Last year I tried to sell a cigarette lighter on ebay , I said was made in Italy which was true, but Zippo corporation saw the ad and said it looked like a Zippo copy they told ebay to remove it . I never even suggested it was a Zippo ( they do not make them in Italy) but ebay still removed it and warned me not to sell copyright items .
As Eddie says, if you believe it to be a fake, take it the Trading Standards dept. of your local council.
Just escalate your dispute after 8 days and return when told to and receive a refund, simple. If you have opened it with eBay they wont ask you to prove it's fake

If you want to go to TS, by all means go, but remember you only have 45 days for a dispute
I always thought that if you buy an item off ebay and you believe it to be fake then the onus is on you as buyer to prove it is fake.

With regards to TS, all very well saying take it there and you will get a letter off them regarding authenticity but my TS would laugh at you and say come cak in 6 months.

The best way to deal with a fake off ebay is say you havent received the item (unless it was sent signed for) and paypal will always rule in your favour.

If it was me I would contact the seller and say you are leaving a negative because the item is fake nad see what he does.

What did you buy and how much was it??
Did the listing specifically say it was genuine or was it just described as a jacket ? if it was just sold as a jacket you have little come back.

If you open a dispute with eBay they will not require you to prove the item is fake

Threatening to 'leave a neg unless ....' is called FB extortion and you could find your account with a mark against it. Too many of those and your a/c may be suspended

I can see this causing problems when you say you haven't received it and the seller produces your threatening emails saying you did.
What is his sellers rating? He probably thought it was genuine. What did you pay for it?

JNO - How is it threatening if I tell a seller im leaving negative feedback for a fake item?

OJ - So PP need proof of it being fake, so you still have to have the item looked at and it put in writing which is still the same hassle as providing ebay with it.
you're missing the point, Jimmycooper. If you send emails complaining about the item, they prove you received it.

Thanks for all your answers. It was advertised as a named item. When I received it I noticed: the size of the logo is the wrong size (all a standard size), The size label is not where it should be, The jacket is not of a good quality, the is no manufacturers logo on the care label (there is on all my other garments by this manufacturer). When i raised these issues with the buyer, he replied : Its genuine. When I pushed further he replied: get me written proof by an expert and pictures within 7 days. The jacket was under £50.00, but it is the principle of the matter and I will never wear it.

You should have studied the auction pics better or if there were none, asked detailed questions before bidding.

How can you study the size of a logo in a photograph? Impossible. Like many things on ebay it was bought in good faith. I would not resell it on ebay as I do not believe it to be genuine.

Do NOT claim INR as above, it will lead you no where

Open a dispute with eBay if you haven't already, escalate after 8 days and return using tracked postage (RM recorded will be fine) when the dispute tells you to do so using the address they give you. You will not be required to provide your seller with prove if you do this, eBay will not ask you to prove it is fake (PP will so dont even go there!)

And there lies the problem - people think ebay is somehow different to purchasing from other places when it isn't.

I am fully aware of the pro's and cons of buying off Ebay. I have bought and sold on there for years. As some people on here have said, I will escalate the dispute with ebay and hopefully get a credit. Job done. I have never had this kind of thing happen before, so wasn't sure what the procedure was. it never ceases to amaze me, how some people have nothing constructive or informative to say about a question posted on here, yet always want to put in their negative, two penneth in anyway. Get a life people.
