Comet refusing ipad 3 return

i purchased an ipad 3 from comet 2 days before apple announced it was being dicontinued for the ipad 4.Apple have said anyone whom bought from them will receive a free upgrade but as i bought mine from comet and the box has been opened they have refused to take the product back.I never tried the product in store as it was a present for my daughter who wants the latest ipad not myself but surely if someone is not happy with the goods they can take them back.The store manager whom i spoke to tonight refused an upgrade but was still selling this discontinued product in store advertising the product still as the new ipad.He also wasnt aware of his products either stating the ipad 3 hadnt been discontiued and i was wrong.In my opinion others including myself are going to be duped into buying this product only to find that this isnt the new ipad.Please advise if i have grounds for complaint as i thought this was the latest and most up to date ipad and not the obselete discontinued one there advertising and selling as THE NEW IPAD.

All this buying the latest gadgets is not for me. I have a phone which I rarely use. Taking it out with me is to to call breakdown service, 999 etc. Never had to use it for that (fingers crossed).
Is a lot of it just keeping up the the Jones?

you should have bought it at an apple store/online from apple. you should have done some research. you shouldn't have opened the box (becomes used at that point - not a 'new' product that can be returned for a refund. stop being greedy and accept you were a donut for not looking into it properly; research the consumer credit act (and learn from it); and tell your daughter (or you, it's not clear) to stop being so greedy and ungrateful that you actually have the money to purchase an ipad!!!!

Just to be clear, the ipad 3 is definately now obsolete. It has been withdrawn from sale by apple, (check their store). It is being deeply discounted by companies and individuals stuck with stock of it. It is also tecnologically obsolesent, as the model that replaces it, the ipad 4 is advertised as twice as fast for the same price with many more tech upgrades
