My partner got issued with a "parking charge" yesterday at Braeahed Shopping Centre, Glasgow. She mistakenly parked in a disabled space that she thought was also for mother and child.

Are these tickets legally enforceable, I have read various threads saying to ignore tickets issued by private companies but most are in England, is this the same advice for Scotland?

If you do the crime, pay the fine.
And stop 'mistakenly' parking in spaces reserved for the disabled.
They're very clearly marked here in Wales (for a reason) as I presume they are in Scotland.

On every other level of the car park the spaces in that location are for both disabled and parent and child except that level so yes it was a mistake!

I agree with doing the crime pay the fine, if its a proper parking ticket issued by the police or council but I am not going to pay some private company if I don't have to. I am sure you wouldn't either!

Thanks for the link, so will you be paying any future fines you may recieve or would you ignore it?
If it's a private company, ignore it.
I live far enough from Braehead to completely ignore the place, but did have a ticket some years ago issued by my local Iceland store.
Showed it to my OH when I came home and he promptly binned it.
Never heard a word from the company which issued it.
Private parking companys can ONLY issue a 'parking charge' this is NOT a fine it is just a request for payment. The only way they can enforce it is by getting a county court judgement against you and they are not going to do that as they would only be awarded damages of the actual amount it cost them to issue the ticket , normally £1 ! . Just ignore it , they will send more letters to try to scare you into paying but just bin them.
Also ONLY the driver of the car is liable to pay not the registered keeper or owner , so just write back and say you were not driving and you do not know who was , they can not nothing about it then.
I think that in Scotland the county court is replaced by another court (sheriffs court?) but the same applies they will not pay the cost of a court case just to be awarded £1 damages .

The other thing is that it was a courtesy car while our car is being repaired so will there be any consequence from the hire company?

Should she let them know she was driving so any letters come to us then ignore them after that?
Don't tell the hire company either.

Pro forma letter by VS of Chorley opposing a private parking penalty and offering a fair and reasonable £10 in lieu.

Dear Sirs,

PCN XXXXXXX/XXXXXX

Receipt of you letter dated 10th June is acknowledged.

The amount already tendered of £10 is, I believe, reasonable compensation to your client and / or you at your client’s premises whilst shopping there. The sum is significantly greater than local car parking charges in the town, many sites being free of charge.

I do not consider I “entered into a contract” with you / your client as I was unaware of the time restrictions on the site (I now consider the signage informing motorists to be inadequate, given the relatively

cramped site where preoccupations of safe driving on the site (should) take precedence when entering the site. As a new customer of your client, I did not have the benefit of prior knowledge of the restrictions.)

I believe the provisions of Unfair Contract Terms Act 1977 are applicable as I am being asked to pay a disproportionately high sum in compensation. As several other parking places on the site were available during the times I was using the parking area, I do not believe you / you client suffered a pecuniary loss. I also believe a Court would award only “reasonable” compensation if it were shown a “contract” existed.

Should you choose to persist in further demands for further payment, consideration must be given to the offence of harassment under the

Protection from Harassment Act 1997.

Sorry EDDIE51 but if you were the driver and you did the following "so just write back and say you were not driving and you do not know who was , they can not nothing about it then." that would be illegal.

Do not deny or admit anything, put the onus on them to identify the driver.
I would bin it..if it is a private company issuing the charge it is not enforcable ...
I do not agree with you telling porkies and saying you were not driving.
Are there any CCTV cameras overlooking this parking space? If so, you may be up the creek without a paddle.
What you can do is write to them and say you cannot remember who was driving the car, ask them to provide evidence of who was driving and say that if they cannot do this, you do not want to hear from them again.
If you simply ignore the letters they can take the matter further.

10 years ago this month, my wife and I drove around a car park looking for a disabled parking space as my mother in law (with Motor Neurone disease) was in the back.

We couldn't find any where close enough to park for her to manage to get to the shops and it took us over an hour to find some where to park. There were plenty of people parking in spaces that didn't have the right to park there ( I am sure they figured that they to could get away with it ).

My mother in law died the following January.

1 hour waster when you only have a couple of weeks to live because people couldn't be arsed to park where they should and there are plenty of forums to tell them how to get away with it....

Ah well - if you don't like how society is turning out, take a look at your own behaviour first.
i do urge parking in the correct places but you do not have to pay these "fines", just ignore, they will write a few more letters then go away.

@Oneeyedvic, I am not condoning parking in disabled spaces at all and neither does my partner! It was a genuine mistake on her part but I don't see why these companies should profit from it!
