George and Helen have lived together for ten years. Five years ago they decided to start a family and although Helen became pregnant, she suffered several miscarriages. Helen discovered that she has a medical condition that prevents her from carrying a baby to full term. Helen’s cousin, Isabelle, who is not married or in a relationship, agreed to have a baby for them and was implanted with an embryo created using George’s sperm and Helen’s egg. Last week Isabelle gave birth to a baby girl, Jessica. She has decided that she does not want to give the baby to George and Helen and has asked George for maintenance. Helen says that she has to give the baby to them, as she and George are Jessica’s biological parents.

Why Helen would have to adopt from Isabelle? She was egg donor than she is the biological mother. I though that the adoption is necessary when donated is only sperm, than she would be as a dad's partner and will be able to apply for adoption. In that case they both are biological parents.
