My Boyfriend had a fight in a nightclub and threw a glass at a bloke as he was going to punch him, he was provoked as the bloke was taking the p*ss out of him. The bloke is pressing charges, he had a minor cut on his head. What will his sentencing be? He has just been to the police station and got his court date for magistrates but they have told him this will go to crown court, this is his first offence, will he go to prison?
If you clarify what offence he has been charged with (Sec 20, offences against the person)?, then I am sure we can find a sentencing guide for you to view.
There's an inconsistency in your post. A minor cut can't result in a GBH charge!
A small cut, not requiring any stitches, would only warrant a charge of common assault. A small cut which required hospital treatment (and might result in permanent scarring) could merit an ABH charge.
You can't be telling us the whole story here. A GBH charge that has to go to Crown Court is going to be serious , the magistrates court can sentence someone to up to 6 months jail, they only send it to Crown court of it needs a longer sentence. A 'minor cut' would not land your BF in Crown Court.
