Section 8 & 21 Eviction Notice
Hi,
Can one of you good people direct me to a free download of the Section 8 and 21 eviction notice please.
I have found on but they are charging £97 !!!

If you goggle "section 8 notice" you get one or two free sites
In the end I bought a book - Landlord and tenant or something and they are in the back (usually)
Since this is clearly a first
for end of lease wh I think is s 21 - you have to put in the day the lease ends and not the day you want possession - this is a must
and for s 8 wh I think is rent arrears - when you come to make a statement of claim you must put in somewhere I am seeking repossession for rent arrears that is ground 8

The form from your link buildersmate gave asks for a full explanation for grounds of the notice but it doesn't show what the grounds are it just gives the numbers. Do I just put two months rent arrears?

I checked my own personal collection of forms before posting
s 21 (easiest)
(i) his name and the rented address
(ii) your name and your home address
and then address of dwelling - the rented address again
(iii) date of expiry: last day of the lease NOT the day you want access
then your signature
the date
and lastly your agents name and address
Unless your lease has said specifically that registered mail is sufficient
then you have to GIVE it to him -or else he will just say he didnt get it.
OK - notice for rent arrears
1. his name and rented address
3 - you have to put in '8'
so that the bit now reads The landlord seeks possession on ground 8 in that.....
and then you have to make sure that the script says what ground 8 is.
4. particulars of each ground as follows:
put in " Ground 8 rent arrears of £xyz.00
and finally you have to fill in the date after which court action may start
andthis has to be 14 d after the date on which you give him the notice
sign and date it .
The court will not give you possession unless the rent arrears are two months worth - but that is the date on which the case is heard.
After 14d apply to the court for possession and try to do it via PCOL
Possession claims on line
If the tenant is staying on after a lease has ended - this is called run on lease and 90% of leases in Manchester are of this nature, use s.21 it is much easier.
make sure that the deposit is with a deposit scheme and not in your pocket. This is vital before you go to court.
also try to negotiate basically that you wont sue for rent if they get out in a reasonable time. Even offer a reference - I will give you a reference but I will have to say that you left in arrears. Anything to avoid going to court it is SUCH a pain in the rear.
If you are driven to court for possession repost....
and good luck - not every tenant wrecks the house but by G+ when you get a diff one life can be hell
