Sick Pay

Hi all,

I am due to go for an operation on the 30th of May. I started my job at the end of Feb this year with no contract of employment. (I have asked for one but was told they "don't do that"?) Anyhoo, my surgeon has told me I will need 6 weeks off work, however work do not pay sick pay. I can't afford to have 6 weeks off so I have agreed to go back after 4 weeks. Can I claim for SSP or do you have to be off sick for so long before you can claim it? Would it be worth it for 4 weeks?

You can get it for shorter periods than that. Look on the directgov site for details, I think.
You will have a contract- it just may not be written down.
Is it a very small organisation? .
You have a right to a written statement of the main terms

Thanks Factor. I will speak to the manager tomorrow and see what they say. I was just curious if SSP would be paid if you are only off for 4 weeks. :)

Ah, your link has just told me I won't get it because I was on ESA prior to starting this job because of my ankle.....bum! :(

The rule you refer to says:

Employees don’t qualify for SSP if they:

-received Employment Support Allowance within 12 weeks of starting or returning to work for you

Looking at your dates I'm wondering whether you may be okay as your absence will be 13 weeks since you started. The wording is ambiguous. Someone may be an expert- tonywilsthire etc- and can clarify

My last ESA payment was the 11th of Feb 2013 and I started work with them on the 27th of Feb.
