Can A Neighbor Park His Car In Front Of His House 24/7 To Prevent Us From Getting Motor Home Out Of Driveway?
We are the last house on a dead end, a gate is at dead end that opens to our acreage. There is white driveway stone to show further access. Neighbor across the street has been haressing us for 4 years from getting our motorhome in or out of our driveway which is 20 feet before the end of road. He has parked up against gate, in front of his house, he refuses to move car for me to get motorhome out and know he will completely block me if I get it out from getting it back into driveway. I have taken him to mediation with him signing agreement that he will not block motorhome, that lasted 2 weeks. I have taken him to court with a lawyer, he agreed not to block our RV's and cease doing 2 other charges I had on him with me dismissing the charges. Two weeks he block this gateway from me getting other RV through gate. I called the police and they said they can't do anything about it cause he was legally parked in front of his house. The town owns the roadway 30 feet by 24 ft wide in from gate, my property is surrounding this litte area they town owns. I showed police letter from lawyers showing of this agreement and was told I would have to go back to court. I pressed charges on harassment, neighbor refuses to move vehicle and I am unable to get either RV out from gate or driveway. I can't take the motorhome out of the driveway in the other direction since it is uphill...with overhang in back my driveway is uphill the tail end rips into the driveway, the town sewer line access to my house would get run over and there is a sharp curb I would have to drive over. So the only way out is in the direction towards our gate. I meet with the town today looking for help which they claim that nothing can be done. I need help!

I'd go further than hc's answer and suggest that if you possibly can - move house. We moved at the beginning of the year after trouble with our neighbour and the minute I walked through the door of the new place it was like somebody had cut a huge knot that had been bunched up inside me. You already know the mediation agreement isn't worth the paper it's written on...

And when he drinks he gets very nasty, he was drunk the first time he blocked me and his girlfriend, now wife screamed obsinities at me while I was waiting for them to move their vehicle. I did nothing but wait. I also caught it all including him spitting on my motorhome with my camcorder that was on the sink facing in their direction Everytime he goes on a roll it's after he has been drinking.
I have surviellance cameras on my house and around my property and caught him many times doing illegal things. Let the police know especially throwing of his dogs poop over the fence, many piles...and still does it to this day...it smells but he is the one that gets the drift of smell. I refuse to go through the poo to cut the grass...zoning officer know this.
I am tired of calling the police, but when he gets out of hand I have to then they say why didn't you call sooner. Can't win.

Property is unbuildable, cheap taxes....gets sinkholes. Seperate deed from our house and keeping it that way. Main property with house is 80 ft wide. With good part of other property I would trust I have only have about 40 ft on that side of the house. And if I move it in that direction I would be direct view from his front windows....hmmmm. That is what the town said to do, move it farther from the house to postion it so I can pull at an angle. Gonna think about that, maybe thy lovely neighbor will get wind of this and move his truck! Wishful thinking...he'll find something else I'm sure. Wish the economy was better. He is in pre forclosure but my lawyer says it will take about two years. Dang!

Hope you find a better home in a state where the police are more strict on sober or drunken trouble-makers.

Solvitquick...one thing I forgot to say, and I feel is the main problem...his mother is dating the chief of police in this town. There are few cops on the force that agree with me and the ones that think I harass him as he has spoken many lies till he realized in 2nd mediation this past Monday that I have audio and video surviellance. I can prove him wrong with all he accused of doing and saying. he was pissed and accused me of eavesdropping...told him there is a sign on my house alerting people of this. He also learned that I don't have 4 cameras but 8....also on the present charges which I will not drop this time, I have proof of his harassing us, plus proof of his harassing on all previous charges that I dismissed but left the courtroom that any further actions from him that I can submit them into court for proof of his character.
My daughter wants to buy our home and start her family but her husband doesn't want to put up with this nut who already harassed her just for parking in front of our house. Real nut.

But you also confirm my sympathetic warning. The more publicity these drunken, callous arses are given the less likely you are to sell your house. Even your own son-in-law is scared of buying.
Here in the UK, when selling a house, the potential buyer's lawyer asks in writing whether you are in dispute with a neighbour, local authority etc. If we lie, then we can be sued for massive damages.
Can't see a way out I'm afraid - suppose you could leave in mobilehome for 6-months and rent-out house to a gang of trouble-making thugs for vengeance, paying them to crucify the arse-holes!

Solvitquick...Hmmmmm...good idea, but we just remodeled the whole house. Hopefully his forclosure will go quickly and he'll get kicked out by the bank. Then my house is sold to my daughter and son in law, she loves this house since we remodeled it complete....especially the kitchen and the land...will be a serenity like it was before.
Not really, the first 5 years I was white knuckled....after that a charm. I am the main driver of this motorhome and just love the thrill of driving to our next adventure...hubby loves to enjoy scenery while going. If we could ever afford it...just a dream...I fell in love with one that is 40 ft long.....pocket doors seperating living room from kitchen with 5 slides. Just a dream...more than likely never happen but we need to dream

Please can you do a drawing and upload it via a photosharing website (picassa or sutchlike)? Can;t for the life of me imagine it all and it;s starting to bug me now. Re the car situation, I'd just get it out as best I can and just scrape his car/bumper or whatever. Worset that will happen is that you;ll need to pay your insurance excess. Then park it across his drive. Re the dog poo, that really is unbelivable. But what I'd dlo it collect up each one and post it to him. Good luck with everything. : )
We had a problem neighbour over 20 years ago, Neither the local council or police could or would help. We felt we had two alternatives--------- Move or kill him. We chose to move. About 2 years later we heard he had died. I sometimes wish we had stuck it out. It was a lovely house in a lovely street. Except for him.

is it really just that he parks outside his home - as he is clearly legally entitled to, and you expect him not to because you have a ginormous vehicle...?
If i had a neighbour who told me i could not park where i was entitled to, which was right outside my home, jut to make manouvering their massive vehicle easier, i would not be too happy either.
