Land Ownership

We live in a terraced house and have an "access" road running along the back of the terrace.  The houses on our side all have back gardens with onsite parking reached via the one lane access road, but the houses behind us (who also run along this access road) only have back yards and have parking round the other side of their houses (are you with me so far...?)  As we are the end terrace we have to reverse our car down the access road to park on our drive - however we often find ourselves blocked in or out by the people on the other side parking in the road.  I have been told by neighbours on our side of the street that our side shares ownership and the people who are causing the problems by parking there only have walking rights to the road.  Who or where can I find out if this is the case?

I should point out that its not that I'm trying to be funny with my neighbours about this - its just that we currently have our house up for sale and everyone who comes to view the house asks about the road.

Hi zukitia, do you have access to the deeds of the house as it may be mentioned in there. I can understand people being concerned about the road, but not only is our current house a terrace with access road and lane round the back, but so was our first house. Fortunately we don't have houses at the back of us, across the lane are our gardens and everyone is considerate and doesn't block people in or out. Has happened a couple of times though with people parking on the road at the front and blocking access!

My other half says that we do have the deeds so I will dig them out and have a look.

Actually, deeds have been done away with and the only thing that counts now is your Registration on the Land Registry computer. To see this click here and follow the instructions. In view of the nature of your question you will have to look at both the Register and Plan. You can also see what is in the Registration of the people on the other side simply by typing in one or two addresses. You can make a copy of all Register's and Plan's to keep.

I looked at our deeds last night and it only shows what land comes with our property so I will contact the land registry today.

We also had a viewing last night and they didn't seem at all bothered by the shared access so fingers crossed!

I assume as you are selling the house you will be getting a solicitor soon.  Might be worth arranging one now as they should be able to tell you what rights people have and shouldn't cost any more as will be part of the sale process.
