Selling Business, Do I Have To Pay Redundency To Part Timer ?

Sister is selling her small shop business due to ill health.The new owner does not require the services of her part time worker. Does my sister have to pay this lady redundency pay. ? Thank you

The new employer is obliged to continue employing the worker unless there is an ‘economic, organisational or technical’ reason why they can't. If such a reason exists it will be the new employer that is responsible for funding her redundancy pay.

(NB: The reference to 'current employer' on that page includes both the old and new owners of the business. The new owner can't get out of paying redundancy pay simply by saying that 'you've not worked for me for two years'.)

The business is being bought by two brothers who say they dont need any other staff, do they still have to pay redundency.

If they buy the business then they're obliged to take on the existing staff or (where they can justify an an ‘economic, organisational or technical' reason, as they probably could here) make them redundant and pay redundancy money.

The fact that she is a part timer doesn't seem relevant to me, if that's your question - the part-timer ha sthe same rights as a full timer
