Flight Delay Compensation

I travelled on Malaysia Airlines flight MH0003 from Heathrow to Kuala Lumpur, thence to Perth on 09/12/13. The scheduled take off was about 11:00, actual take off was about 19:00, due to the plane being defective and a new part was sent from KL. All passengers were given a document by the MA staff explaining that compensation of €600 / £500 was payable under EU law because of the length of the flight and delay.

I applied by email to the address given on my return, received a case number and acknowledgement, but have since heard nothing, despite sending chase-up emails.

There are solicitors who operate on a no-win no-fee basis but they charge 25% plus VAT of what they recover, which seems a lot since I'm only getting what I'm legally entitled to!

Wouldn't I be better going through the small claims court, or is that not an option since I'm dealing with a foreign company?

I think you'd be better by ringing and ringing the airline or their customer services at LHR until you got an answer rather than e-mailing. Presumably everyone on the flight was entitled, they can't have ignored the whole lot of them.

A bit over three months is a fairly short time span for many big organisations to pay out in, so I wouldn't get too concerned.

However if you continue having problems, the relevant body to appeal to isn't the County Court but the Civil Aviation Authority. email [email protected], phone [phone] (Mon to Thu, 0930 to 1430 only) or write to:
