Unfortunately my sister died recently without leaving a will. She was widowed, had no children so presumably my other sister and myself are next of kin. My sister is older than me and has said she will sort everything out. She is already telling her daughter what she can take from the house and I don't feel this is right. Can I insist that I am also an administrator of the estate. Thank you.
Has she already obtained letters of administration? If not make it known that you wish to be included, so yes you can insist on that and imho ought to do so.
I agree with kvalidir. I don't think being 'next of kin' is the right term here but it's almost certain the estate will be shared between you, once any debts have been paid. It's not a good idea to dispose of assets until the full extent of assets and liabilities is known
why don't both of you arrange to go to the house and go through things, in case there i anything you want? if your niece is taking trinkets and furniture, i wouldn't worry too much i suppose - unless you have a burning desire for them, in the end it'll probably just cost you to get rid of them anyway.
if she had loads of expensive jewellery and antiques, then things are different
