my daughter found an elastic band in her food ( samwhich , local producer ) she told me she choked a little on it, she is 6 years old. it was bought locally in a small supermarket.

my wife who is from thailand just threw it in the bin along with the samwhich. my daughter told me this today on our way to school. if it had of been me i would have taken it to a claims court or back to the shop though maybe it is not the shops fault.

what usually happens in these situations ? if i were to claim and send evidence into solicitor. people could choke to death on something like this so i feel it a serious enough isssue to claim.

Unless the shop actually made the Sandwich it's not their fault but that of the Sandwich makers.
Claim for what?
For the future, you need to go through local trading standards. You won't get money but the issue would be dealt with to help other people. If you leap off to a solicitor, you will have to pay up front and might be out of pocket. Keep in mind that unscrupulous people have added their own objects to food in the past to get money so its not as easy as rocking up at the solicitors with a sarnie and a rubber band.
what would you claim for though - she didn't choke on the elastic band.

what would you lot do ?
I'd go back to the shop with the elastic band, sandwich and the packaging and let them know what happened and ask them to contact their supplier and inform me of the outcome.

Is samwhich a reginal term? Never come across it before.
I'd do what Eccles suggests.

I would take it to trading standards and let them deal with it....but as i said, its easy enough to buy a sandwich and add a foreign body to it!

It's all hindsight anyway, as the offending sandwich is now in the bin, but in future, just take it back to the shop you bought it from and show them.

Good job the mouse did not fall in the KFC coating and get deep fried, you could have eaten it without noticing !
What would I do?.....The same as I did when I found a piece of glass in a salad in a Devonshire tea shop recently......be happy I didn't eat it....point it out quietly to the owner....have a nice chat with her and refuse her offer of not paying for my lunch. Though she did pop a jar of home made jam in my bag as I was leaving....

If a foreign object in a bit of food is the worst that happens to me I'm a happy bunny...what difference would claiming make to anything?
