I Have No Mot Or Tax And Had A Crash
42 Answers
i have had a crash, the fault of which i am unsure i would say 50/50 at a guess. as the title shows i had no mot or tax. i had my car booked in for an mot the day after. i was driving in the opposite direction of the mot facility when the crash happened.
i have insurance though not sure whether it is valid, also i have not got a clue who i am insured with so have no way of contacting them.
i asked the guy whether he could hold out on notifying the insurance companies until the day after, to which he agreed but after trying to contact him he is not answering his phone.
i am truly lost to what to do or how to go about the situation, any help would be much appreciated.
thanks

Driving without a valid MOT certificate CAN'T invalidate the '3rd party' element of an insurance policy. So the good news part of my post is that you CAN'T be prosecuted for driving without insurance. (The insurer MUST pay out in respect of any valid third party claim). The first part of the bad news is that, depending upon the wording of the policy, your...

No there has never been an MoT reminder service from the government in England & Wales as far as I know.
“You need to report the accident to the police .”
He does not providing details with interested parties were exchanged – which it seems they were.
“There is no such thing as paperless insurance , you must have a printed policy document, that is law.”
I have had no printed documents sent to me by my insurers for at least the last three years. I have .pdf documents provided by them either by e-mail or from their website which I may or may not print as I choose.
“You do need to tell the police as offences have been committed and the accident has not been reported to insurance”
Again, not so. Section 170 of the Road Traffic Act says this:
170 - Duty of driver to stop, report accident and give information or documents.
(2)The driver of the mechanically propelled vehicle must stop and, if required to do so by any person having reasonable grounds for so requiring, give his name and address and also the name and address of the owner and the identification marks of the vehicle.
(3 )If for any reason the driver of the mechanically propelled vehicle does not give his name and address under subsection (2) above, he must report the accident.
(4) A person who fails to comply with subsection (2) or (3) above is guilty of an offence.
There is a simple way to remember when Tax, MoT and Insurance expires:
1. Get a bit of paper and a felt tipped pen
2. Write on the paper, with the pen:
Tax expires on dd/mm/yy
MoT expires on dd/mm/yy
Insurance expires on dd/mm/yy
3. Stick the bit of paper somewhere prominent on the dashboard or perhaps the lid of the glovebox.
4. Look at the bit of paper from time to time when you get into the car.
