Hi all, son wants to take child out of country for family wedding. Part of this will be in school time. School has authorised a few days of it but cannot authorise last couple so they would be unauthorised. Son and ex partner cannot agree and ex has said he is not allowed to take her. They both have parental responsibility but she lives with ex. My question is can she stop him from taking her. Thanks for any answers.

he would be wise to listen to ex I think.. it could cause problems with future visiting etc ?
Would it not be possible to just take child to the wedding for a few days then return her to school? I am assuming that the wedding is not taking place in a far corner of the world....

Hi, no it would not be possible as flights back are only once a week. She agreed to the holiday at first then after it had been booked she changed her mind.
As the child resides with the 'ex' her Mum I think her views take priority. Plus schools can get quite awkward about unauthorised absences and issue fines.
yes she can stop himif she does not give permission. He could be charged with child abduction if he takes her without permission
If the school enforce a fine the ex will also have to pay it. Anyone with parental responsibility has to pay it so she may be baulking at that.
With joint parental responsibility does she also need his permission to take the child abroad? Is her objection because of the school not authorising the whole trip or is she simply being awkward?

Thanks for the answers. She was fine with it until he booked it. Yes she is being awkward. He said he would pay any fine for both of them. He has had enough now so is going back to mediation as she has done things wrong in the past like moving and changing her school without informing him. She wouldn't sign the forms at mediation the last time but did take on board the telling off she got from them so now he is going to go all the way and get them in writing so she can't keep moving the goalposts.
