My mum who is 95 has moved into a care home and I am selling her house. Her neighbour has said he is putting up a fence where the original fence is that my father put up some years ago. I have said I do not think that is right and he should put it on his side of the boundary. Because we will be selling the house I do not want to get into legal wrangles about the fence and so I have told him he should put it on his side of the boundary. I am right and can anyone advise- he will not discuss it say I am being ridiculous. Please help.

He went to the nursing home and told her he was putting up a fence for his privacy now she has gone. It seemed to be fait accompli, not asking if he could use the same fence posts just doing it . He said she was going to pay for it - she says she said no such thing - she maybe 95 but she's not daft she has all her marbles.Mum has left everything upto me and my husband but I always discuss things with her. Her hung up on me I was not rude, and he got quite personal.
I think your fence thing is
the posts have width and the fence was nailed on his side and he wants to replace the fence and nail it on your mims side thus snaffling a strip of three inches or whatever the width of the fence is
tell him the fence is his and he has to maintain it
and DO NOT get into a dispute -
you have to say in preliminary doo-dahs whether you are in a dispute or not and this will dampen anyones enthusiasm to buy
so the money YOU get goes down
walk away from this with more money by not speaking
