Gifts In A Will

My late brother in law put in his hand written will that he wanted his best mate to have his railway wall plates. My sister has tried several times over the past 8 years to give them to his friend but he does not want them. How does by sister stand if she gives these plates to a charity shop. Not sure of the legal issue here. The will was not made through a solicitor

His friend could take them to the charity shop, couldn't he? No law broken then, if there is a law...?

If it was me, I would get the friend to sign and date a note saying he doesn't want them and you can do with them what you will or he could name a charity for them to go to. At least then you have covered yourself from any potential wrongdoing.

Folk can alter a will after a death by making a variation as long as all those affected by the proposed change agree to it.

Yes I’d just get the friend to drop her a note, text, email saying her relinquishes all claim to the plates, just in case they turn out to be worth thousands.

get the best friend to write that he doesnt want them

then they are your sisters to do what she wished

happens a lot on the continent as Napoleonic code says the lucky recipient has to pay the tax and it is grequent for the lucky soul to look at the French tax bill and say non merci
