Riviera Travel Refusing Cash Refund

I was due to travel to Italy 1st May with Riviera Travel. They have cancelled my holiday and offered to re-book or holiday voucher but no cash refund. Checking on the ABTA website it says that the rules regarding refund for cancelled holidays have not been officially changed.
Can I take Riviera Travel to small claims court ?

I am sorry but the question regarding taking Riviera Travel to small claims court has not been answered !!!
I doubt small claims court would take the case a t the moment. Did you pay on credit card- if so try a chargeback.
I assume you can't get hold of Riviera travel to insist on a refund- some companies have stopped taking calls
Have you asked them why they refuse to refund? If so, what reason was given?
I believe most companies will try this but try checking your rights as a consumer, as for small claims, I wouldn’t go down that road
...and I note that (at the time) you didn't bother to comment on all the replies...
If they are members of ABTA then a complaint to them wouldn't go amiss. Less bother than small claims court too.
You’re not going to get a 100% definitive answer on a website forum, havalo. I took the time to research the Ts & Cs of the travel company and copied and pasted a section which seemed to suggest you have a case for a full refund, however, it would probably require the expert services of a lawyer to follow that thru.

You took no time to give any thanks to anyone on your previous thread which is rather ignorant.

I can not get Riviera Travel to answer the phone. When sending an e-mail all I get is an automated reply telling me somebody will be in touch which does not happen. I know they are desperately trying to hang on to customers money, but that does not help me and many others from needing that refund.
Have you told us whether you paid any of it by credit card?

I have paid by credit card.
Well do a claim to the credit card company- they will do it for you but be prepared for it to take up to 4 weeks a s they are stretched due to workloads and absence levels
Then barry1010’s answer in your previous post applies. Did you obtain the s75 form?

I dont know the answer to your question, but I wonder if you would consider the choice between postponing your holiday and Riviera Travel surviving as a business, or it being forced to refund everyone and collapsing altogether?
you can usually claim via the card's website- I did. Probably coincidence but within a few days the money wa srefunded to my card
Maydup, the op says that they need the money.
I was wanting to do that with my cancelled Jet2 package but I couldn't access the system or speak to them to explore the options. They sent a link to amend the date but it didn't work. They weren't taking calls either. So the only option seemed to be a S27 claim. I now have money back and am looking at booking same holiday with them now for October as it's my favourite hotel and we go every year so I wouldn't want them to close down
