End Of Lockdown Restrictions

Restrictions change on Dec 2nd, so.... Mrs Dag going to hairdresser on 2nd, but... is that the last day? meaning restrictions still apply all day until Dec 3rd begins just after midnight? Many sources on the net don't agree!

It's only a few weeks since the Northern Ireland administration had to admit that they didn't know their own rules and that their lockdown would end a day after they'd said it would. (They later extended it anyway, so it didn't really matter in the end). So it's unsurprising that the English (i.e. UK) government doesn't seem to know its own rules either!

The original announcement definitely indicated that 2 December would be the last day under lockdown, with 3 December being the first 'free' day. However the Gov.uk website now clearly states "The new rules will come into effect from the beginning of Wednesday 2 December", meaning that 'freedom' will come a day earlier than previously planned.

We have new rules here in Portugal to cover the Dec 1 and 8 holidays. From the Friday pm to Tuesday pm no travelling outside council areas. No schools or public services on the Mondays and asking all non essential business to close. High risk councils no leaving your home, except to walk the dog, medical emergency or to help disabled relative after 1pm on Sat and Sun. All shops to close at 1pm and take away or home delivery only for restaurants. All returns to normal at 5am on the Wednesdays

CHRIS, that guidance is not correct according to the relevant legislation.

Reg 1(2) of the Health Protection (Coronavirus, Restrictions) (England) (No. 4) Regulations 2020 states,

"These Regulations come into force on 5th November 2020"

Reg 23(1) states,

"These Regulations expire at the end of the period of 28 days beginning with the day on which they come into force."

That means it ends at the end of Wednesday 2nd December.

We seem to be back to the position that applied in Northern Ireland a few weeks ago then, when the Stormont executive was forced to admit that they'd been working to the wrong date for the end of their lockdown period and that it would actually go on for a day longer than they'd been saying. (i.e. they'd not read their own legislation properly!).

So one of the following must be true:
1. Boris and friends can't read their own legislation properly ; or
2. Boris and friends can read the legislation properly but the civil servants who put information on the Gov.uk website can't ; or
3. The new regulations, which will bring the revised tier system into operation in England, repeal the existing regulations with effect from the start of 2 December.

I'm happy to admit that I'm CONFUSED!

Bojo's statement doesn't help much either!

(Quote 1): "I can therefore confirm that national restrictions in England will end on 2nd December, and they will not be renewed".

To me, that would seem to imply that the current restrictions will apply up until the end of Wednesday 2 December. However, in his very next sentence, Bojo then said . . .

(Quote 2): "From next Wednesday people will be able to leave their home for any purpose, and meet others in outdoor public spaces, subject to the Rule of Six."

Of course whoever drafted the legislation/the PM's address/all the other cobblers we have been fed recently tell us we should rely on their advice and follow it without question. So, ask yourself this: should you follow the advice - much of which is based on the interpretation of complex data and involves you making quite radical changes to your behaviour -when it is provided by somebody who cannot count up to 28?

Before the hairdresser opens she should check whether the new legislation (which will probably not be available to view until about four hours before it comes into effect) specifically rescinds the existing edition. If it does not then the hairdresser will be breaking the law if she opens on December 2nd.

you will get arguments when official advice is conflicting, I suppose. Have you rung them? They might have put a message on their phone about when they plan to reopen.
