If I own a property which is my main residence and buy another property to move into as my main residence without selling the first property I have to pay a higher rate of SDLT because I will own two properties. If I sell my previous main residence within 3 years I can claim a refund. however, if I own a buy-to-let property and buy a second property to move into as my main residence (moving out of a property I am renting) - again I must pay the SDLT surcharge - but can I claim a refund if I sell the buy-to-let property within 3 years?

I think you have got confused about SDLT ( anything over £125 k)
and CGT
(no CGT if it is your primary residence
