We have an LPA with a Building society for an elderly relative. When setting it up we were told by said BS that all mail and statements, cards etc would now come to us instead of the donors address as this is what the BS insisted on.

We have just discovered that the donor went into their branch and got all the addresses changed back .

Sorry, although it seems wrong, I don't know for sure. The first step should be to ask the Building Society whether they broke the terms

I did find this

"A Lasting Power of Attorney (LPA) is a legal document, therefore it can only be revoked or overridden by the donor through the OPG if they have mental capacity or through the Court of Protection if it needs to intervene."

Does your relative have mental capacity? If so, she has the right to make these decisions and manage her finances, even with the LPA in place.

Question Author

She can't even remember setting up an LPA .

we don't think she has the mental ability any longer but we organised the BS with her permission

As her attorney you can insist the BS sends you copies of all correspondence and give you internet access to her accounts.

Has your relative been formally diagnosed with loss of mental capacity, has she been assessed?

Does she have a health and welfare LPA?

Question Author

Yes assessed refuses the welfare LPA

This is what the Nationwide BS says, I expect all to have similar

If a lasting power of attorney is being registered with us and the account holder has lost mental capacity, there are a few things we can do for an attorney. But it depends on what is permitted in the power of attorney document and whether they're acting ‘jointly’ with another attorney.

Unless there are limits or restrictions in the power of attorney document, we can cancel the account holder’s cards, chequebooks and online access if an attorney requests this. We can also send statements to the attorney.

Question Author

Thanks looks like a call to Nationwide is in order

Is it a Nationwide account?

You also need to read the LPA to see if there is any specific instructions eg Attorney can manage all my investments and savings accounts but not my current account whilst I have capacity

Question Author

It is a nationwide account, it was at their insistence that the statement and mail come to the attorney.
she forgot her pin again and went and ordered a new one and changed her address at the same time
