my partner owns a property he bought with his ex wife approx 18 years ago they split he paid her off the house is in his sole name. he then met the mother of his children who moved in to his house and lived with him for about 7 years before she left taking the children with her .at that time things became very strained csa were involved and he was hit quite hard financially which he still pays at that time she wanted some financial settlement out of the house and consulted a solicitor he in turn being stubborn and financially drained ignored the letters subsequently she had the land registry put a restriction on the property and has been there ever since in that time he hasn't been able to change the mortgage home insurance sell the property basically the house is now quite neglected .we got together i have my own property and he now wants to move on she has been contacted and asked what she wants and is going through the solicitors but she is really dragging her feet which in turn is costing us both money we haven't got can you tell us what we can do
Presumably your partner and his ex own the property as tenants in common. If not, it should be changed to this. You then simply apply to a court for an order to sell with the proceeds divided accordingly stating that the members of the TIC cannot agree on how to manage the property. It will not be refused.
