In a civil law suit when you are subpeoned does the party which you are being a witness against know prior to the court hearing that you have been supeoned.
The Civil Proceedure Rules require the parties to the case to serve copies fo the statements of all their witnesses on each other. If they cannot get a statement from the witness they have to serve a summary of the anticiapted evidence. In short, yes the other party should know all the witnesses who will be giving evidence for the other side.
