my husband owned a property with his parents his father died and we had his name taken off the title deeds the tenancy was joint with right of survivorship his mother had now died and his sister has been to see a solicitor about making a claim against the property we have furnished them with a copy of the title deeds but they are now applying for the original ones which shows his fathers name but that will be the only difference can she still go to court
She can go to court but if the facts are as stated she won't get anywhere. Unless she was financially dependent on your mother and no other provision has been made for her.
Her solicitor is probably double checking everything (as his his job) and when he has finished he OUGHT to advise her to drop the case.
The original deeds have been obtained and as we knew the only difference is my husbands fathers name appears on them but the fact remains its a joint tenancy with survivorship - whats the worse we can expect his sister to do. thank you;
