What will happen when I go to court ? I
..found out that My Insurance company had cancelled my Insurace without my knowledge they took out two payments by direct debit then stopped taking any more. they said they had sent me a direct debit to fill in but had failed to return it within 7 days this I never recieved. Although they had a phone number which they could have contacted me on. So I was unaware that my policy had been canclled until I rang up to put in a claim. I have always driven with Insurence in place. Any help would be great. ps the mandate is still in place according to my bank

my husband was in a similar situation to you years ago. through the insurance companys fault my hubby got 6points and a fine, like i say that was a few years ago.

Did you get a Certificate of Insurance when your policy was renewed?

If not you will be deemed to have known that you were driving uninsured.

yes i have a full policy document as well as the cover note i am scared to death allways bin legal

Had something similar recently. The insurance company had sent the renewal to our previous address, we'd only just moved house. We'd written to them with the change of address details but they said they never got it. Because we didnt take them up on the renewal notice (that we didnt receive) the insurance lapsed. Sods law obviously kicked in and we had a small accident, went to check the insurance and found out we didnt have any! It had expired a few days earlier. In the end we had to settle the other persons claim for damages ourselves without involving their insurance company. This was for a minor accident - could hardly see the damage, I dont know what would have happened if we had to go through the other party's insurance.

It wasnt a good situation, I know how you feel. Can you settle directly with the other party?
