whats the procedure when an unmarried couple split up?

One child (4) not married, house in both parties names. Both refuse to leave the property? She works and can buy him out (50% ?) he is not working and so cannot buy her out. She will be the child's main carer. Both refuse to leave despite long term breakdown in the relationship. She because its her childs home and he because he has nowhere else to go. Any advice please? He needs to get a job and if not rent then go to Housing Association and get a new place. Her buying him out, right more like providing for him so he doesn't need to work. I'm sorry, I know I am being harsh but you seriously can't expect the mother to move out start afresh, look for a new house, pay for the man whilst looking after her 4 yo. I know break ups are hard, but that is just ridiculously selfish. What gives me the right to say that? The fact that I went through the same and I wouldn't wish it on my worst enemy.

Firstly, I would tell both of them to get solicitors and then see if they can arrange a mentoring session where they can speak to someone about their case for wanting to stay in the house. The chances are that the man would be advised to move out because the courts would look favourably on the woman with a dependant child. She is also in a strong position, offering to buy the man out.

She can take this to court but it will cost both of them a great deal of money and in his situation he should start looking realistically at the future.
