can a parent with equal paental rights gain a residency order without the knowlege of the 'absent parent'?

How absent is the absent parent? The court would decide on any residency order so i guess it depends on the circs.

What would be the reason behind getting an order if a parent was absent, to protect against the absent parent taking the child?
