He has not yet been to trial. it went to pre trial in Feb this year but the police still had not had their case prepared, it went to pre trial again in August and the out come was the same. One of the witness who claimed he has been Assulted has since dropped his charge and we are now calling him has a witness to try and prove that the 2 abh charges are faulse. the state emnt for the landlord my partner and one other witness are exactly the same as are the 2 relatives that were with my partner. there were 3 statements that differ and one of them has with drawn. the injury caused to the land lord was a "superficial" cut to the lip. he was not kicked or punched and didnt fall to the ground. The incident according to the land lord ended here at the door. So how 2 other guys got hit at the door and the land lord didnt see doesnt add up. He has been on Bail and not had any trouble for the last 17 months does this count towards sentancing?

This has taken a long time to get to trial. Provided that the delays have not been caused by the defence then the court will take into account the length of time this matter has been hanging over him.

It is for the prosecution to prove its case your partner does not have to prove anything. If there is a witness who undermines the prosecution case then this wil go a long way in establishing reasonable doubt
