he then phoned me (got my number from ebay) and it got quite tense and then the cheeky b****d said if he got a visit from the police "it wouldn't be the last he'd see of me because he knew where i lived (on the paypal details) and worked (where I asked him to send the item). It's only a phone for christs sake but I'm scared. i can't belive he'd do that - i spoke to the police who weren't really much help - i see their problem in that they said they would investigate it but what about my safety in the meantime.

Now I don't expect them to lock him up until this whole thing is resolved but I can't believe that he can scare me like this and I really don't know what to do. It;s such a small insignificant thing but I'm trying to be a good citizen. What should I do??

you said he got your address from paypal,so why dident you just report it to paypal,they would have got your money back from him for you,usually paying by paypal covers you for this sort of thing, tell him you have reported it to the police,hes not that stupid to do anything now as he will be the first one they go to.

You have to report this to the Police "officially" and involve the person who the phone was stolen from.

It's also report the threats, get down to the local police station and demand to see ever higher levels of people until action is taken.

1/ Unfortunately Paypal won't readily refund your money unless they can retrieve it from the seller. I would guess he immediately withdrew it from his Paypal account. I know they say they will, but in reality you're going to have a struggle to get it back (I speak from personal experience). And always fund your account from a credit card, and you'll get another layer of protection from fraud.

2/ Report it all to the police.

3/ I think you're going to have to give it back to the real owner. But do get some proof of ownership first, as this whole thing could be a scam.

4/ OK, hindsight is a great thing, and it's no help now, but why on earth did you put up your real phone number on ebay? My address details on ebay are deliberately misleading, and the phone number is a total fabrication. OK, he would have got your work address, for the delivery, but don't make it easy for them.

5/ Try to calm down a bit. I realise it's upsetting, but it's easy to threaten somebody by phone, a lot harder and riskier to actually do anything.
