I have a neighbour who parks over my drive which prevents me parking on the drive. They have also parked over the drive whwn my car is parked on it. What are the legal implications & what will stop her - being polite does not help

Hi, If your kerb has been lowered to gain access to your driveway and you have had planning permission and have had a letter from moleseye then you can tell your lovely neighbour to move her car or she will be in danger of having her car clamped depending on where you live i.e england. She might even be fined if she persists in parking over your driveway as the police will tell her to remove the car. It is against the law in the uk to block access in or out of your property. Hope this helps.
just a note
whether the kerb is lowered or not you still have a right to access a driveway to your property.
have a polite word if all else fails contact the police who will issue a fixed penalty notice for causing an un neccessary obstruction.

if there was a fire and you couldn't get your car out because it was blocked by your neighbours car it could have even more serious consequences.certainly speak with the police for the legal way to go about it if your neighbour will not comply
Go out during the night and get a few mates to help you bump their car out into the road, then they should get the picture. Or you could just ask her, or get the police involved...
Hi,

A colleague of mine had the same problem.

According to the police - if his car was in his drive the car parked on the road was blocking his access to a public highway and was therefor breaking the law. They used to arrive on the scene and move the obstructing car.

If he was trying to get into his drive from the road, the police were powerless to do anything. This in their eyes was a private matter.

drew is right. blocking exit from your property is an offence. blocking entry isn't. so get the police to get it moved.
if they carry on get two vehicles, park them so close (1" or so ) to the front and rear of the offender and teach them a lesson.
also try blocking your neighbours property with mates cars and leave them for a couple of days, just to make your point! (make sure you aren't blocking them IN though )
