i am thinking about chaning my son's surname in to his fathers, does he get special rights over me by doing this?

He will never have rights over you.

I assume you are not married to the child's father.

If you mean will he get rights in respect of the child - only if his name is put on the child's birth certificate after 2003.

Or he gets a parental responsibility agreement which will give him equal responsibility for the child. This has to be witnessed by the court.

Or he marries you.

It's only a name....You don't have to name your children after either parents if you don't want. You could name your child after your mothers maiden name. It doesn't give your mother rights over the child if you get my gist.
