Flytipping on private ground

I live in a small street of privately owned houses. At the rear of my garden is a pub. One of my neighbours has thrown over their high garden wall a fridge freezer. I've spoken to the pub landlord and he said he has been told that legally he cannot do anything to get it removed. He cannot get it out through the pub garden without cutting down some trees. My neighbours and I have spoken to our local authority and they say they can't do anything because it is on commercial land. Environmental Health say it isn't a danger. Even though it is immediately next to the children's play ground in the pub!!

Is there anything else we can do please. It is an eyesore from our rear facing windows and gardens, particularly now we are in the autumn and the leaves have fallen it is in clear view.

Is there any possibility of putting it back into the owner's garden?

It's our last resort. But I suspect they'd throw it back over. I cannot understand how people can do things like that and not care.

Throwing litter, refuse etc. is not illegal when thrown from private land into private land.

However, if the fridge or act of throwing it has caused any damage to any property, the owner can be reported to the Police for criminal damage as there is no way they could not deny the act was a reckless one.

The act could also be seen as evidence of anti-social behaviour.

Some people are a disgrace. They have no love or respect of England and our countryside. My thoughts are with Ethel's,sling the thing back,and see if you could find a bonus one somewhere to keep it company.
There has to be some legal way round the situation,I don't believe people can be allowed to deposit rubbish wherever they please without there being some law, by-law that protects the environment.

As a fridge has refrigerant gas in it it is classed as hazardous waste, there are strict legal rules on how to dispose of fridges.

Environmental health are completely wrong with their answer.

I think the pub landlord probably could make more of an effort to remove it, however he would be responsible for paying for it and that is not a good incentive. If it were me I would contact my local Councillor and say you are very concerned about the possibility of a young child climbing into the fridge and you will find that something will probably get done about it .

Thanks all of you for taking the time to reply. My neighbour complained to the Env Health about the fridge gases, danger to children etc. and they didn't want to know. I even offered to pay the cost of removing the fridge but the Landlord is right in that he would have to cut down several trees to get it out. I reckon our only way is tipping it back over the fence. Before I do anything I am going to report it to the Police and see if they show any interest.
