Drink driving .

My idiotic brother-in-law (aged 18 and stupid!) took his friends Audi TT for a spin at 5am on Saturday morning. He had been drinking until closing time the night before. He predictably drove it through traffic lights on red and straight into a fence. A witness phoned the police, he was brethalized (positive) and arrested. He was brethalized again at the police station and it was negative. They released him without charge. Does anyone know how much trouble he is actually in and whether the police will charge at a later date? I am very surprised he was released considering he was a/ driving recklessly, b/ driving without insurance and c/ driving under the influence. Many thanks

nykkieberry - sounds like he was darn lucky, hasn't he been served with a HORT1 [produce docs withing 5 days], they usually do that for all prangs. Didn't they say anything? get a good lawyer's advice - suggest you ctc Treacle via answerbook @yahoo groups if she doesn't pick up on this. Bet his friends well amused!

Thanks Paulz. I'm amazed he hasn't been charged - I can't see hwy not myself! (and I think it would do him the world of good - he's a lovely lad but heading slightly off the rails at the mo) His friend was incredibly understanding and said it was his fault for letting him borrow his car when it was inevitable that if you stick an 18 year old 1 litre Fiesta owner behind the wheel of a brand new Audi TT at 5am after a nightout, it will end in tears. I give up!

he had a very good brief? i would be very suprised if he's got off as scott free as he says he has. if he was tearfully sorry, offered to pay for damage to fence, pleaded ignorance, stupidity, youth etc etc and the police were in an incredibly good mood and his previous record spotless, they may have let him off with cautions, especially as it appears that no-one got hurt and the car owner does not want to press charges. just how sorry he would have to have actively been is not something an 18 year old is going to readily admit too and imho theres more to that story than he's letting on. i suggest you post a question asking for as many audi / fence / idiot jokes as possible and keeping rubbing it in, truth will out sooner or later.

I belive HORT1's only HAVE to be served when a third party is involved. But he must have had a very leniant / inexperienced officer to allow him to slip through his or her fingers without the need to produce his docs.

Yes - I had to produce my documents once for driving too slow!! LOL!!!!!!
