clean break order
my partner is now divorced but when his solicitor asked his ex to sign the clean break order, she refused unless we disclosed our income.we did ,so naturally we asked for her full disclosure.she has not complied, has ignored all legal parties and when our solicitor contacted her solicitor he said that he has not been able to contact his client therefor cannot take any actions.
she left my ex with over 10,000 matrimonial debt but because it was mainly in his name we was advised to just have a clean break order and for him to pay off the debts
he works to pay csa& iva and now are legal aid has run out we dont know what to do regarding the order.we cannot afford to pay private and we are angry that his solicitor let her continue to ignore letters and never issued her with a court order if she carried on to not co-operate.
his ex and partner have there own home, car, good jobs and this is why our solicitor said she,s refusing to co-coperate due to her being part owner of the property, but yet failed to push her for her financial disclosure.
how do we get an order so we can get on with our lifes and not have it hanging over our heads if she falls flat on her face and comes to us for money in the future.
my partners IVA is only for 5yrs then he will be debt free
