2 weeks ago, I was involved in a collision with another car. She had come out of a drive way into on coming traffic.
I was driving in the outside lane of the duel carriageway with cars stopped in the inside lane. One of these drivers flashed her and she came out to the line in the inside lane.... I saw her sitting there and slowed down..but because she was stationary, I assumed she had seen me and was letting me pass.
When I was approx 2 cars away from her, she pulled out infront of me...and with no time to stop, we collided.
She admitted liability immediately saying she was turning right and was too busy looking left for on coming traffic and "forgot " to look at the outside lane where I was.
My sister arrived on the scene and again, she admitted to my sister that she was at fault.
Now my insurance company are saying she is denying liability and my sister's statement is worthless as she didn't see the accident and is therefore not a witness..she could be claimed to be colluding with me.
I have put up a poster at the site to see if any of the drivers will come forward....getting a witness is my only hope otherwise the insurance companies will go 50:50 and I cannot afford to loose my NCD and excess.
I am so angry at this...Is there anything else I can do?
My insurers dont seem to be in any way bothered about finding her at fault and appear to be quite happy to accept the 50:50 when I am most certainly not!

The woman would have stood a good chance of being charged with careless driving on two counts: 1) she didn't look and 2) she relied on a headlight signal which should not have been given. Unfortunately, insurance companies are only interested in saving their money. Someone will do doubt say that an injury is required before it can be reported to the police. but that is not true.
Basically, she changed lanes on a dual carriageway without looking? She is at fault therefore. Write to your insurance company telling them that you do not consider this to be your fault and that you will claim, through the small claims court if necessary, if they penalise you.

In response to my poster, a guy has phoned me stating he witnessed an accident and wondered if it was the same one....which it was.
I will forward his name and number onto my insurance company on Monday and they can do the rest.
Does anyone know if this is deemed viable? I know that in this case I am incredibly lucky as in most cases "Good Samaritan's" dont exist.
Will they take on board what this guy has to say? Incidentally, he said he saw a 4x4 cross directly infront of the car infront of him (which was me)..so it backs up my story.
