Returning Shoes to Nike
I bought a pair of trainers from a Nike brand store and after wearing them on a walk, found they were too small (the assistant advised me that I was wearing trainers the wrong size for me)
I tried to exchange them for a bigger size but the store refused saying that because they had been worn outside they wouldn't - the shoes are not marked or dirty, just a little dust on the soles that a child could wipe off.
Can they do this?

They are not faulty so they don't have to exchange them. If they have been worn then the shop won't be able to sell them for full price to someone else. I suppose you could argue that they were missold if the assistant told you they were right for you but I don't see how you can prove it.
I did try them on in the shop but there is only so far and for so long you can walk in a shop! It was when I walked round the block that my toes went numb.
What gets me is that they were willing to exchange them when I first brought them back but not when I said I had walked out of doors in them.
There is no reason why they couldn't resell them - there is not a mark on them and I took a dry cloth over them at lunchtime and you couldn't tell the difference.

well, you are a grown up and should know what size shoes you take, so you cannot expect them to change them.
i suppose from what you have said they could as a gesture but they don't have to.
however, i would ask them nicely - or take them to another branch and not mention the outside walking - they will check the soles and if there is genuinely not a mark on them, then they will refund them, or, get someone eles to take them for you.
if this doesn't work i suggest going in and informing them that you intend to make a complaint to head office about the sales staff advising you on the wrong shoe size. it is there job to sell you shoes and most are trained to assist in finding the perfect fit, with those shoe size contraptions, she should not have interfered with your choice without taking a measurement first.

The consumer law states that goods must be refunded if:

Anything else is goodwill of the shop. If you had taken them back without wearing them at all, with all tags still attached, you would not have been legally entitled to a refund - unless there is a notice in the shop stating that goods can be returned in the state sold within x days.
Sell them on eBay.

The tags are still on the trainers! You all seem to think that I've done a half marathon in these trainers but all I did was walk round the block! I know several people who buy clothes and shoes, try them on at home and take them back the next day!
Thank you to all the people who have explained that they do not have to take them back - I appreciate that. But yes they do have a return policy which does not state that you cannot wear them outside.
May I reiterate that they were willing to exchange them BEFORE I mentioned that I had tried them. So I am not so bloody stupid as some of you suggest I am.
