Can my employers legally withhold pay (due on the 15th April) for overtime that has already been worked?

Is he actually witholding it (ie never going to pay it) or did it miss the cut-off date to get it in the payroll for 15 April and will be paid later.

Another possibility is that because of time off since the overtime it's not overtime any more, but normal hours.

But he can't legally withold it for no reason. If he has a reason, providing it's genuine, then maybe.

No, SMBC are just not paying it on time as per agreement, we have all fulfilled our timesheet obligations but they are stalling for some ambiguous end of tax year "reason" basically I think it's all very, very dodgy and illegal. This is a huge local government department and hundreds of thousands of pounds are being held for no good reason. I expect that they'll be earning interest on it whilst it sits in their account and the rest of us can go suffer!
SMBC won't save money if you and your colleagues enter Employment Tribunal claims for unlawful deductions from pay. Get the union on the job.

Hi thanks for your replies. I've contacted Unison and GMB but alas it's Easter and everywhere is closed which is rather frustrating. I've also contacted an employment law solicitor and will get onto it in earnest tomorrow when normal service resumes. SMBC have pushed us once too far this time. Watch this space!
