Cannock Gates, refund?
Cannock Gates recently went into administration. I ordered gates before this happened. It has now sold the goodwill and assets of its gate business to another company. This new company has said they will still deliver my gates. However, my question is, can I ask for a refund or can they legally say no as my business was with the old cannock gates, not the new one?

Are they sticking to the agreed timeframe? If they are going to be late delivering, you could give notice that if they do not deliver as agreed you will cancel as 'time is of the essence'.

There is no connection between the old and the new company except the similar names and the buying of the goodwill and assets - it might just as well be called Gates are Us. As far as I can see, you could ask for the refund.
As an aside, recent comments on the quality of the service provided by the old company was removed from this website by the Administrator at the request of the company. I make no comment about whether the comments were good or bad, and I draw my own conclusions about the company.

I've just received my gates from the new company and I'm really pleased with them. I spoke to someone about my order as I was really worried - I was told that the company that had bought the gates division had agreed with the Administrators that they would supply outstanding gate orders as an act of goodwill. They also explained that they weren't in a position to offer refunds as they hadn't taken any money for them - the money was taken by the old company which is now in administration - so if you want a refund I guess you have to speak to the Administrators (Ernst & Young) and join the creditors list (which normally means you get pence in the pound).
My best advice though it to speak to them - I found them really helpful and I was told that the new owner is a successful group of companies from up north who have been around for 75 years and really care about their customers.
As for the threads being removed - the problem with boards like this is that lots of people give answers that are factually incorrect and sometimes they turn into a general slanging match - neither of which are very helpful to people like me who want help and advice!
