noisy neighbours

hello
i live in a block of 3 flats, top, ground floor and basement.
i am having trouble with my neighbour above me. he makes a lot of noise in the early hours of the morning. it sounds like he is moving furniture and i have even heard the hoover go on at 2 or 3am before now too. i dont get a lot of sleep and i have to get up for work at 4.30am every morning. can anyone give me advice about this as i am losing my temper.
p.s, we both own our flats.

what does your lease say about noise?
My lease states that we are not to make any loud noise after 10pm and before 7am, must be respectful of others at all other times and we are not allowed to have anything other than carpet on our floors to minimise noise too
have you actually spoken to him to see if you can sort this out?

i have just checked my lease and it basically says that no musical instrument, tv, radio, loudspeaker or mechanical or other noise making instrument of any kind shall be played or used and no singing between the hours of 11.30pm to 8am and at any other time so as to cause nuiisance or annoyance to any other owners and it also says that the floors must be carpeted.
i cant speak to him, he gets too aggressive and threatening, which also makes me angry too.
then write a polite letter asking that he be a bit more considerate at such times. maybe the person below you hears the noise too and you can sign the letter jointly.
Speak to the owner of the freehold owner and see if they can perhaps write to him also as he is going against the terms of the lease.

I knew of a neighbour that did this and it turned out he was sleepwalking and had no idea he was doing it! Most normal people don't hoover or move furniture at that time of night so perhaps bear in mind this could be a possibility.

hi meglet.
he was definatley awake as he banged on the floor after i shouted at him and he also shouted some horrible things back at me.
if that was the case then i would probably understand but i dont think it is.

Your best bet then is to check out what your lease says (usually there is something in there about noise in my experience) and then write him a polite but firm letter explaining that his behaviour is unreasonable and breaks the terms of the lease. Explain that you will be keeping a diary of all times that he makes excessive noise outside of the times stated in the lease and, if he doesn't desist, you will be forced to contact both the landlord and the council.
