Who can I make a claim against?
My neighbour has recently had Block Paving Installed by her Son-in-law's brothers company. This work took place over 3 weeks ago. The company in question during the installation of the paving have caused considerable damage to my drive and the pavement/road outside the properties (the edges of my drive have crumbled in some places upto 12 inches from the boundary line. This is due to the fact they used my property without my permission as a means of access for their excavator and dump truck. (A nice suprise when i returned home from work) These vehicles caused the majority of the damage.
I have asked the paving company over the phone twice to come and repair my driveway including replacing the kerb stones but my requests keep getting brushed off.The last call I made regarding these repairs ended in him telling me the work wouldn't be done if I kept ringing him...At the end of this week it will be a month which I feel is an acceptable amount of time for these works to have been completed.
Can i make a claim against my neighbours home insurance as she has the contract with this company?
Or can i have the work done by another builder and send the bill to this block paving company?
Small claims court etc.
Any advice to help resolve this matter would be apprieciated.

I would formally ask them in writing, the letter sent by recorded delivery, if they have already said they are going to do the the work, to accept responsibility for the damage caused. If they refuse to do that or give you a date when they will come and do the work - tell them - again by letter that the work will be done by another company and the bill will be forwarded to them and a claim made in the small claims court.
