court proceedings
I have been fighting (through solicitors) for over 12 months now with my ex partner regarding him trying to register a charge on my property. He sold me this property 2 years ago and I have it in writing from him that he was selling it me for x and I paid him x. He is now saying he wants more money from the property. The case is due to be sent to the adjudicator next week, his solicitor is trying every tactic possible to delay things (thats all he's done all along). They are now saying this letter he gave me was not signed by him so it is a fraud and if I do not agree to this they will call in a handwriting expert. I have no problem with this. But it is just another way of holding the procedure up. How many times can the land register grant him time extensions. I feel that this is going to go on forever and a day. I now actually want to take him to court as waiting for the land registry is an absolute farce. I know if I lost it would cost me thousands but I have so much evidence and he has nothing, so I am quite prepared to take the risk. Obviously once I inform my solicitor to take it to court, she will do, but what will be the procedure now and how long do these matters take to get to court? Sorry to waffle on. What would your advise be, keep with the LR or go to court. Thanks
