my parnter divorced hes wife 10 years ago and she remarried moving to america
the judge ruled that he remained in the family home to raise the two children and that should he sell the property a percentage of the sale would have to be shared with he ex-wfe. one child has left home and the other one is age 19. the exwife will be returning back to england does she have any legal right to force him to sell the property

She could go to a solicitor and ask for her share if she's legally entitled to it now the children are grown up. But as it was such a long time ago, if she didn't make any payments toward the mortgage, If it were me, I'd argue (through a solicitor / court) that I'd brought up 2 kids & paid the mortgage and that i would feel it unfair that she benefit from any sale, giving that the house will be worth a lot more now than it was then. If he fights it, he may get it overturned or at least the percentage lowered, I'd certainly give it a shot.
Surely she would be owing quite a lot of money in child support payments?

I would imagine that could be offset against any monies owed from property.

Thanks for all the good advice, she had kept of the maintance for our children until they turned 18
