Unneighbourly neighbours
Have recently been the victim of unreasonable behaviour from upstairs neighbours (they rent - I have a mortgage), (lots of noise at night - 12am through to early hours of morning, ie. talking, heavy walking and shouting out of windows etc.). Polite letter was sent on Monday - no acknowledgement from them - Landlords have been to see me, they are in denial of noise issue and have dismissed these out of hand. Want to try and get this resolved as this is giving me severe depression not to mention the victimisation I feel. Want to do it in the right way and not feel angry or fretful.

Best action would be to contact your mediation group. It would be listed under your local council telephone number.
If all else fails, then get in touch with the Anti Social Behavour Team, this is also run by your Local Council. They will interview them and yourselves and monitor the situation.

Start to make a diary of every incident. Log times, dates and level of noise on a scale of 1 to 10.
If they are approachable, knock on their door and tryto appeal to their better nature.
Once you have contacted the authorities, you will be liable to disclose any dispute information on the SPIF, if you choose to sell.

first things first in cases like this it is hard to prove a lot of the time because the police look upon it as a civil matter, and asbos arent worth the paper they are written on .is the flat you own a former council flat or is it one where they are all supposed to be private tennents? if it is the earlier the housing association or council have to deal with it. if it is the latter then unless you have a resident comitee in place you will have to gather evidence yourself this can be logged evidence or video evidence if it is video though make sure the tapes are colour.in any event you should get in touch with your local council and ask for practical advice on dealing with noisy neighbors

Thanks everyone, i really appreciate your advice in my hour of need. I have been keeping a noise diary for the last 3 months. I sent my neighbours a "nice" letter as advised by my local authority. I also spoke to the landlords of the property who are in complete denial. They seem to want to pass it off as "everyday noise". What at 4am??? i dont think so. This conversation with the landlords has left me completely deflated as they were my last hope. I know the council will get involed but the noise is very difficult to prove and as you say, if it becomes official i will have to declare it if im ever in the lucky position to be selling. Its all a nightmare and it makes me sooooo angry that private landlords can stick unsocialble tenants into private homes, wreck innocent peoples lifes and theres nothing we can do!!!!!
