my brother was charged with harressment and is due to appear in magistrates court next week to be sentenced. The evidence was based in his mobile phone ( text messgaes) he is first time offender. whats the worst that can happen to him?

i dont know why you think asking 3 times will get you a better answer. You have answered your own question previously by putting the bit about 6 months prison or fine or both. So i guess the worst that could happen would be 6 months prison and a fine!

I posted yesterday that I find it very odd that a charge of harrassment based on text messages got to court.

Do we know all the facts??
im with Rev, isnt it usually just a caution or restraining order?
Had your brother done anything else? threatened her? hit her? damaged any property?

Well the fact is that he met some polish girl and fell in love she took every thing he had and walked! he could,nt get over it so he text her and followed her around for nearly 2 months until he met another girlfriend but it was too late the EX went to the police and now he's done for harresment and due to appear in court: thats the story.
I know I 'am borring you guys but hey he's my bro what can I do?? your there and some one to talk to. I am at college when I should working on my notes I am talking to you .
Even if he was following her, wouldnt the police of had a word first?

To go to court you need to have done something bad and being caught doing it
so he was stalking as well as texting her then.

Unless you give people on here all the info how will they ever be able to answer your questions.

I dont think that saying his girlfriend was a cheat is an excuse for following her around and texting the things you say he did. Its not the actions of a settled mind, even if it was a short term lapse.

I realise hes your brother but try and look on all the facts.
If he was following her for 2 months surely the police would have known and told him to pack it in?

To be charged with it there must be witnesses apart from the girlfriend

There are no wittness but the police took his mobile and kept it for 2 months the charge is based on that and she said he followed her around - I have read the charges the police gave him and thats what it reads.

I am worried never the less. seems too far gone - court case for this i would have thought a caution would have been enough. but tax payers money now thats pushing it.

but he did and thats what he got. I am not makeing this up cross my heart!!
he has harassed her by following her and texting her. The texts corroborate her evidence that he has stalked her. If you accept that she is telling the truth about the texts - which is evidenced by reference to the messages he sent, then she is likely to be telling the truth about being followed.
