Removing a PAID default?
3 Answers
Hi
I have read all the threads regarding removing a default notice. My credit is in near perfect order except for one company. I bought a car steroe on buy now, pay nothing for 6 months. I set up a direct debit for the first payment, but by the time it came round I forgot about it and the direct debit bounced. I didn't know anything about it, until I got a demand for the full payment (no default notice by the way). I just thought "hey-ho, it's only 250 I'll pay it all now". And that was that.
3 years later, I want to buy my first home and I think I'll get a credit report. I notice a default on my account - I ring the company to ask why - they said because I missed one payment they defaulted me. My reaction was "What, for ONE missed payment?" and they replied (get this) "No, because it was pay nothing for 6 months, your payment bounced on the 7th month so it's listed as no payments made for 7 months".
I looked at some threads on here and wrote a letter asking for a copy of the default notice etc.
They replied, "As you account has no outstanding balance, there is no obligation for us to supply this information. This is specified in section 78(3a) of the Consumer Credit Act 1974"
Is this right? Is there nothing I can do?

You can write to Experian / Equifax and tell them that you have not been notified of the default in this case and that you are disputing that you were given a default notice. Ask them to get on your behalf a copy of the default agreement since the lender will not provide it. It is doubtful whether this will get anywhere but may be worth a try.
