i got arested in may and the police said that i can have my phone back that i had on me after court and evry time i have phoned the police staion the officer in charge is never there i had a solicitor at the court and now that she has been paid for helping me in court she dont seem to want to help me get my phone back what can i do to get it back court ended in july and still have not got the phone back

Write a formal and Intelligible letter to the Local Police Chief, stating the case number, arresting date and officer involved. Then ask what day and time may you collect your phone.

The chief has an obligation to respond.

Any solicitor would help get your phone if you paid them. Or were you on legal aid???

If you were on legal aid do you think the public purse should really spend between 175-500 pounds per hour trying to retrieve your phone??? Errrr no!!!

I assume the phone was also some form of evidence in the case. I am afraid they have the right to keep it in case you lodge an appeal (if guilty).

If it is prima facia evidence of the offence (i.e harassment etc) they do have the power to destroy it.

As said, just write a nice letter.

Pointless writing to the Chief Constable, it will be dealt with by his secretary and be redirected straight to the Inspector of the station concerned. Therefore go straight to that Inspector in the first instance.

Also the vast majority of Police Officers will have a force email address which will be readily available from their call centres. Maybe try that means.
A friend of mine was arrested on susp of possessing cocaine and bailed. She is a 61 yr old great granny who was actually in possession of a bag of glucose powder. Once the powder was tested, that was the end of the matter. However, when she was arrested (in February) her mobile phone was seized and she cannot get it back. She gets directed from pillar to post with the police.
She has now written to the senior officer at the local station and said that unless they return the phone to her in person within 7 days she will file a complaint of theft against the arresting officer.
u should contact the independant police complaints authority giving them the date, time, officers number and the will contact the local police authority. i did recently about the police harrassing me and it was acted upon swiftly.
