How can I avoid a newly built property becoming entitiled to Ancient Light?

You can't change the law. A prescriptive easement, granting a 'right to light' (which is the more modern term for 'ancient lights') is created, under the Prescription Act 1832 where there has been an enjoyment of light for a continuous period of 20 years. Any new property is likely to acquire an easement eventually. Until it does so, the owners can still object to planning permission for a neighbouring property if there will be a significant reduction in their light. It would be up to the planning authority to determine whether the objection had sufficient weight to cause them to refuse the application.

i think you will find that there is no longer a right to light, its ben replaced
