I have been split from my partner now for three years or so. We own (as joint tennants) a property with a joint mortgage. Our son also lives in the property. I have moved out and she is paying the mortgage now in full every month. I am now getting married and want to buy a house with my fiance, but need to realise the equity in my other house. My question is - can I force my ex partner to sell? and should I sever the joint agreement and become tennants in common?

I am going through the same as you at the moment. I split from my partner 4 years ago and he is living at the property. We have a joint mortgage but he has been paying it since I left. I am seeing the legal people at the CAB next wednesday but until then I can't give you an answer, Will keep you posted tho.
